Terms of Service

By creating an InfraCaptain account or using any part of the InfraCaptain service, you agree to these Terms of Service ("Terms"). If you are using InfraCaptain on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the service.

InfraCaptain provides a server monitoring platform that allows customers to:

• Install a lightweight monitoring agent on their Linux servers
• View real-time and historical server metrics in a web dashboard
• Receive alerts when server health, security, or performance thresholds are crossed
• Use Captain AI to ask natural-language questions about their server's state
• Access optional DevOps expert assistance via the Assist add-on

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. We will provide at least 30 days' notice for material changes that affect existing paid subscriptions.

You are responsible for:

• Maintaining the security of your InfraCaptain account credentials
• All activity that occurs under your account
• Ensuring that the servers you connect to InfraCaptain are servers you own or have explicit authorization to monitor
• Keeping your contact and billing information accurate and up to date
• Notifying us promptly if you suspect unauthorized access to your account

You must not share your account with others outside your organization. Each server connection token is intended for a single server and must not be reused across multiple machines.

You agree not to use InfraCaptain to:

• Monitor servers you do not own or have explicit authorization to monitor
• Attempt to access other customers' data, accounts, or server information
• Reverse engineer, decompile, or attempt to extract the source code of the monitoring agent or platform
• Introduce malicious code, viruses, or any harmful content through the agent or API
• Attempt to overload, disrupt, or interfere with InfraCaptain's infrastructure
• Use the service to collect data about third-party infrastructure without authorization
• Resell, sublicense, or provide the service to third parties except as permitted under an agency or white-label arrangement with our explicit written consent
• Circumvent or manipulate billing, credit allocation, or plan restrictions

While our engineers provide expert guidance, the final execution of commands or approval of changes remains your responsibility. InfraCaptain/Coreway Solution is not liable for data loss or downtime resulting from actions you explicitly authorized our engineers to perform.
The Assist add-on provides optional access to certified DevOps engineers. The following specific terms apply:

• All engineer actions on your servers require your explicit approval before execution
• A complete audit trail of every action is maintained and available to you
• Engineers are provided read-only access by default; write access is granted only when you approve a specific action
• InfraCaptain is not liable for outcomes of actions taken with your explicit approval
• Unused Assist hours roll over for the period specified in your plan (2–3 months depending on tier)
• Assist subscriptions can be cancelled at any time; unused hours at cancellation are not refunded

Your use of InfraCaptain is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• We collect only infrastructure monitoring signals — not your application data, credentials, or user information
• You retain ownership of all data collected from your servers
• We do not sell your data to third parties
• You can delete your account and all associated data at any time

We aim to maintain 99.5% platform uptime. Planned maintenance will be announced in advance. Unplanned outages will be communicated via our status page.

We are not responsible for data collection gaps caused by: your server being offline, network issues on your end, resource exhaustion on your server that prevents the agent from running, or events outside our reasonable control.

InfraCaptain, including the monitoring agent, dashboard, Captain AI, and all associated software, is our proprietary technology protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for the purposes described in these Terms.

You retain full ownership of your server infrastructure and any data collected from it. By using InfraCaptain, you grant us a limited license to process your server monitoring data for the purpose of providing the service.

InfraCaptain is provided "as is" and "as available." We make no warranty that the service will be error-free, uninterrupted, or that all alerts will fire in every circumstance. Server monitoring is a best-effort service — we are a monitoring tool, not a guarantee of uptime.

Captain AI diagnostics are AI-generated suggestions based on your server data. They should be reviewed by a qualified person before being acted upon. We are not responsible for outcomes resulting from actions taken based on AI suggestions.

To the maximum extent permitted by applicable law, InfraCaptain's total liability to you for any claim arising from your use of the service will not exceed the total amount paid by you to InfraCaptain in the 12 months preceding the claim.

We are not liable for indirect, incidental, special, or consequential damages including but not limited to loss of revenue, data loss, or business interruption — even if we have been advised of the possibility of such damages.

You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard. Upon termination, your monitoring data will be retained for 30 days then permanently deleted.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, fail to pay amounts owed, or use the service in a way that harms other users or our infrastructure.
